North Kingstown Man Ordered to Pay Restitution for Grease Tank Pumping

Police say Timothy J. Smith, 46, didn't pay for maintenance work at the Rhode Island Quahog Company.

WAKEFIELD – A North Kingstown man has been ordered to pay $2,525 in restitution following a bounced check for two grease tank drainages at the now-closed Rhode Island Quahog Company at the Carriage House Inn on Tower Hill Road.

Timothy J. Smith, of 111 Atlantic Ave., North Kingstown, pleaded no contest on Feb. 16 in Washington County Superior Court to a North Kingstown police charge of writing a fraudulent check for more than $1,000. According to an Oct. 2009 article in The Northeast Independent, Smith was the owner of the restaurant.

Superior Court Associate Justice Edwin Gale ordered Smith to pay $2,525 in restitution. An undetermined deferred sentence would be imposed if Smith failed to adhere to his payment schedule.

According to North Kingstown police reports included in court documents, the fees stemmed from two pump-outs at the restaurant in April 2010.

Police said workers at Diffley and Daughters Septic Sewer and Drain, Inc., drained the grease tanks at the restaurant on April 15 and April 24. A $2,500 check was given to the company, but it bounced, which incurred a $25 fee.

According to a letter submitted to police by the drain company’s attorney, follow-up efforts to get Smith to pay the fee were unsuccessful, and police were called as a result.
