Judge to Rule on NK Fire Union v. Town

A Superior Court judge will make a decision on a preliminary injunction filed by the fire union against the town.


Superior Court Judge Brian Stern is expected to rule in the North Kingstown Fire Union's case against the town next week.

In December, Local 1651 filed a preliminary injunction against the town after the . Stern’s decision is anticipated on either May 4 or May 7.

. The new shift changes went into effect on March 11, moving firefighters from 10- and 14-hour shifts to 24-hour shifts and average 56-hour work weeks — adding 14 hours to their weekly schedule. The restructuring of the department could save the town approximately $1.2 million, according to Town Manager Michael Embury.

“I’m hopeful that the court rules in our favor,” said Local 1651 President Ray Furtado. “These 24-hour shifts are resulting in many guys working 48 hours in a row, sometimes 72 or even 96 hours. This creates a harmful situation for people in our town and the firefighters alike.”

Local 1651 also filed an unfair labor charge in December. According to Union President Ray Furtado, the state’s labor board has issued a formal complaint against North Kingstown. . Furtado asserts that the council’s move to pass the 24-hour shift as a town ordinance circumvents the collective bargaining progress and violates state law.

On April 30, the town and fire union will begin negotiations for next year’s contract.

Amazing how you want to insist there was a cut in pay as the opposite is true......statements such as yours ruin your credibility, guessing that it doesn't matter to you. Just as amazing is how you blog as if all is well so let me inform you as all is not well. Concerned resident where are your facts ? You said and I quote "there was a cut in pay as the opposite is true" so I ask you to show us your facts and sources ! ... If someone is working 56 hours a week and is only being paid for 42 hours how does that not result in a cut in pay ?? ... And I ask you to specify about that one word you said "volunteer" ? .. Are you saying you would like to see 61 men and women lose their jobs ? Are you saying that you would like the town council spend more taxpayer money to fund this "volunteer" fire department ? Are you saying that your ok with delayed response times and a decrease in the level of care and professionalism that comes with a "volunteer" fire department? Are you saying that you think a "volunteer" fire department can handle over 6000 runs a year annually on top of the mutual aid with neighboring towns and cities? .... I ask you again please specify your previous statement and endulge us with your opinion, thoughts, and beliefs. But please give us links to factual evidence as to how a "volunteer" fire department would be an improvement and benefical to the residents and businesses in north kingstown !

Big mouths like him just like to stir the pot, but if he did "volunteer" he wouldn't have time to go for training, would bitch about 2am ems runs, and can't leave work since his boss will not let him or would dock his pay. Seems to me there was a reason decades ago that the Wickford Ambulance Corp folded and the Town decided to man outlying stations since the "volunteers" no longer could handle the workload in any sort of reasonable time. Maybe he thinks you can schedule a fire in advance like in Theatre of the Absurd by Ibsen. Let's see what the courts have to say. Either way, Kinder has made a bundle at concerned residents expense.

I appreciate your question as the cut in pay is a union deception - play on words. As I keep reading that NKFF are professional I would think that they would want to act as such. Most will tell you that a cut in pay is an actual reduction in their pay which is something that has happened much to many residents. In fact the NKFF received a pay increase at the time of the ordinance change. I'm hopeful that makes sense.....you also have a good night.

Not my call or yours. That is up to the members of the NKFD to decide if they wish to pursue it further in the court system and the Labor Board. I'm sure Kinder will be doing the same with the TC if Stern rules against them. I do love your name calling while you offer nothing other than hot air not based in reality.

I never said that I would like to see any lose their jobs. It is that when push comes to shove the town will need to do what is best for NK. I might suggest you read as to what is now happening in CA and its compounded issues. In the past most started in CA and worked its way east and I am confident that in this instance the same will hold true and unfortunately the worst is yet to come. I would like to ask you if the judge decides that the town is - was correct in its ordinance changes - will you admit that they were justified in their actions?

Look... we KNOW we're broke (government is broke and taxes are out of headroom, in fact too high which is why RI has a failing economy). I just dont think this council picking on public safety is the place to start, although honorable negotiations would be okay. The TEACHERS are the biggest union in NK, almost 400 of them and they get 75k for a 3/4 year job PLUS health (minus 20% they pay) PLUS stipends and bonuses for such things as masters degree which they all get PLUS when they retire, we're on the hook for ANOTHER approx 1.5 million pension! (They pay around 9% a year toward that which is NOTHING compared to the outlay back to them when they are retired). This compensation package has a LOT of room to reduce and still be paying a square deal for that job. TEACHERS: Biggest union, biggest pay, start there.

First and foremost I don't wish bad times on any which includes you such that I hope things improve for you. It's apparent that your personal issues have pushed you into an attack mode defending the few and the wrong. Funny that you attempt to pull police into this discussion, hmmmmmmm. Concerned: Thank you for your concern. Don't put words in my mouth though. I may be a pawn, but I never said for any union. I like to support those people who have helped me and my family over the years. I've had a fire (minor damage), the FD showed up, my family has had medical emergencies and the FD rescue showed up. I've had our home broken into and the police showed up and actually caught someone. I'm not pulling police into this. They always have been as part of public safety. Fortunately for them, this current episode does not impact them. When bad things happen, these are the people you turn to. They need to be there in a fully functioning capacity. I see every day what is going on very clearly! This mess didn't happen overnight. The economy sucks as does the job market especially for us around here for our sixth decade. I see no point in the back and forth on this issue. It sounds as if you never will be happy even if you hit the big one in Powerball. If you truly feel things are so bad in NK, look around the rest of the country (a novel idea, I'm sure), RI isn't the only place with pain and suffering. Perhaps you can find an oasis somewhere else. Remember the grass is always greener.....

No words in your mouth trust the truth. I never indicated that fire, police etc. do anything except a fine job. I'm guessing you don't mind increased medical cost as you Dr does a great job with you.....shall I continue?? I'm guessing you didn't watch the pention reform hearings.....shall I continue?? Looks as though your support of the FF is self-serving without regards for anyone else. Possibly a pay as you go system would be better for all concerned - bet many would see improved efficiencies with that concept. Not hearing any about NK schools I'm guessing that you don't have any kids in school.....at the same time you probably wanted any and all for teachers while your kids were in school. As you indicate there is pain and suffering in many if not all area's but at the same time the majority has no desire to roll over allowing unions to continue expecting more from residents during these difficult times.

if we have a volunteer system they need to do a few 24hr shifts each month in the fire house. That is the system we have now, as a taxpayer I am not willing to wait for the volunteers to responded the fire house to get the trucks and responded to my emergency

Got to enjoy your typical union response of take it and shut up! Perhaps a pay as you go would suffice. Even better provide dept's with a budget and done! Any way’s, the majority prefers that if you are going to remain in NK that you stop your lies and deceptions. Although, I’m sure that towns such as Central Falls (I’m sure you could assist NK into bankruptcy), West Warwick (I’m sure you could assist NK to the brink of failure), Woonsocket (I’m sure you can assist NK raise resident taxes) on and on and on could utilize your infinite wisdom. In the event you want to do NK a favor and leave, perhaps the train station can facilitate your departure. Thug – the individual that knows all!

so may 4th, 7th, and the 20th have come and gone and the residents of North Kingstown are still waiting for a decision!. is the town or judge waiting till all the firefighters are out on injury (from working over 80 hours a week due to understaffing), retired ( 25 eligible to retire last fiscal year), or leaving for other departments (warwick, cranston, providence etc etc...) ...... nothing has been mentioned at all since this ordinance has been made!!!!!
